TERMS OF PARTICIPATION & DECLARATION FORM

The following are the terms and conditions for registration and participation in Tree of Life Juice Fasting

 

Retreat Workshop described herein (the "Workshop" or “Retreat”) between Tree of Life and You (either an individual or a legal entity that you represent as family or an authorized employee or agent) ("You"). Please read them carefully. BY CLICKING THE "I ACCEPT" BUTTON OR SIGNING A COPY OF THIS AGREEMENT, COMPLETING THE REGISTRATION PROCESS AND/OR ATTENDING THE WORKSHOP, YOU ARE STATING THAT YOU ARE ELIGIBLE TO PARTICIPATE IN THE WORKSHOP AND THAT YOU AGREE TO BE BOUND BY ALL OF THESE TERMS AND CONDITIONS OF THE WORKSHOP ("AGREEMENT").

The Participation is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein.

 

1. DISCLAIMER OF WARRANTIES.

 

Changes are periodically added to the information herein. Tree of Life and/or its respective suppliers may

make improvements and/or changes in the Workshop's program at any time, with or without notice. Tree of

Life does not represent or warrant that the Workshop will be uninterrupted by external factors or forces. Tree of Life does not warrant or represent that participating in the workshop will have positive effect on your health or mood.

THE JUICE FASTING PROCEDURE IS PROVIDED "AS IS" AND THERE ARE NO WARRANTIES, OR

CLAIMS MADE BY TREE OF LIFE AND/OR ITS SUBSIDIARIES AND AFFILIATES, EITHER EXPRESS,

IMPLIED, OR STATUTORY, WITH RESPECT TO THE WORKSHOP, THE ACCOMODATIONS, INCLUDING WARRANTIES OF QUALITY, PERFORMANCE, OR FITNESS FOR A PARTICULAR MEDICAL OR PERSONAL PURPOSE. TREE OF LIFE DOES NOT WARRANT THAT THE WORKSHOP, THE JUICE FAST, WILL MEET YOUR NEEDS OR BE FREE FROM ERRORS, OR THAT THE OPERATION OF THE WORKSHOP EVENT WILL BE UNINTERRUPTED. THE EXCLUSIONS AND DISCLAIMERS ARE AN ESSENTIAL PART OF THIS AGREEMENT AND FORMED THE BASIS FOR DETERMINING THE PRICE CHARGED FOR THE WORKSHOP. SOME STATES DO NOT ALLOW EXCLUSION OF AN IMPLIED WARRANTY, SO THIS DISCLAIMER MAY NOT APPLY TO YOU.

Tree of Life's (and its partners and suppliers) total cumulative liability to You or any other party for any loss or damages resulting from any claims, demands, or actions arising out of or relating to this Agreement shall not exceed U.S. $500.

 

2. SERVICE LEVELS

 

Tree of Life does not guarantee the Workshop will be performed partially or fully or at the announced dates:

(1) caused by any change of Your medical condition, Your failures to meet the terms in this Agreement, or

Your ability to arrive to the Workshop's venue. (2) relating to events beyond Tree of Life's (or its partners and suppliers) control such as strikes, riots, insurrection, fires, floods, explosions, war, governmental action, labor conditions, earthquakes, natural disasters, or (3) medical inability of the workshop's organizers and leaders to perform the workshop.

In any case of the above, There will be no compensation towards your flight and travel expanses to Israel. In case of cancellation on behalf of Tree of Life due to the above cases, a refund for participation fee will be subject to actual workshops or accommodations services provided in part or full, their relevant actual costs spent. The registration and booking fee of 8% is non refundable in any case.

 

3. MODIFICATIONS TO TERMS OF PARTICIPATION AND OTHER POLICIES

 

Tree of Life reserves the right to change or modify any of the terms and conditions contained in this

Agreement or any policy governing the Workshop, at any time, by posting the new agreement to the site

located at www.treeoflife.org.il (or such other URL as Tree of Life may provide as ticketing services,

listings, indexes, affiliates, or others). You are responsible for reviewing the policy prior to completing

registration. and again 14 days or less before attending the Workshop for event info updates.

No amendment to or modification of this Agreement will be binding unless 

(i) in writing and signed by representative of Tree of Life, 

(ii) You accept updated terms online or by signing and updated Agreement, or

(iii) You attend and participate the Workshop after Tree of Life has posted online and sent to the email

address You provided updates to the Agreement or to any policy governing the Workshop 14 days prior to

the Workshop.

 

4. THE WORKSHOP ARRANGEMENT

 

• The workshops are done in a retreat setting - a break from life’s routine for the purpose of rejuvenation & learning.

• Visitors:

With the aim of maintaining the quiet and intimate atmosphere around the group, you are requested to avoid from receiving guests and visitors during the workshop. If you need to see visitors you could do that at the Reception Office. Visitors are not allowed to the Workshop's facilities.

• Participation in Activities:

There is no requirement to take part in all the activities.

Your participation is compulsory (must attend) in these talks only: 1. entering the fast 2. coming off the fast 3. daily morning check-in talks with Dr. Cousens.

• Leaving the Workshop's Area: You are requested to stay within the area of the Village throughout  the

2 retreat. Driving out or leaving the village area requires Doctor’s and workshop's manager approval. In case you plan to leave for a few hours please let us know in advance.

Leaving the village accommodations designated area by car or walking is in any case at your own full

Responsibility.

 

• Driving While Fasting: In any case that driving would be approved by the Dr., It would be limited to 15 min drive only. If you need to leave to Workshop's area you will need to use public transportation or have

 

somebody else driving for you. Driving while fasting for longer then 15min and without a Dr. Approval is at

your own total responsibility.

• Fasting Environment: in order to maintain a proper fasting environment, 

 

the following are NOT ALLOWED IN THE WORKSHOP'S AREA AND ROOMS:

 

Smoking or using of alcohol

Pets

Eating

Using of cellular phones is not allowed in public and workshop areas Loud music or noise, specifically after 10pm.

Please avoid using strong perfumes.

 

5. TERMS FOR DOUBLE ROOM PARTICIPANTS

 

We generally find that people have ok/good/great experience with their room partner. HOWEVER please

read and accept this important notice:

If you buy a Double Room Ticket alone You will have a random partner of the same sex sharing the room

with you. Tree of Life is not held responsible for choosing the right partner for you other then matching two

partners of the same sex.

Each of you and your partner will need to leave the room for an hour everyday, to allow privacy for your

partner to do the daily detox practice. (enema, etc')

Once arrived at the workshop, it will not be possible to change rooms or partners, or to upgrade to a single

room. In any case changing or upgrading your initial ticket and room type purchase is subject to availability

at that time, before and while at the workshop. Upgrading to a single room while already at the Workshop is required from both You and your room partner together and is subject to availability.

In the rare case that your medical or personal condition may require that you to be moved to a Single Room, according to the organizers decision or Dr. guideline, you could choose to either break the fast and leave or upgrade to a single room at your own expanses.

If you know yourself to be be a 'Heavy Snorer', if don't sleep much in the nighttime, if you require space to

perform your phone calls, work or practice, we strongly suggest that you choose a Single Room.

In very rare cases, a difficulty arising of you and your partner not coming along, that is beyond the

reasonable, may lead to separating / terminating participation at the cost of the person held responsible, due to medical or personal issues, and subject to the cancellation and termination of participation appearing on this Agreement.

 

6. CODE OF CONDUCT

 

The workshop has a spiritual and self-development quality. If your behavior during the workshop should not

meet the code of proper behavior, for example, your behavior towards the general staff or to other

participants would not be respectful and would cause interference to the participants or staff, you will be

warned, and later may even be asked to leave the workshop, at any stage and without any refunds – (at the most exceptional cases). The workshop's organizers reserve the right and their responsibility to maintain a pleasant and healthy group atmosphere throughout the whole time. Accordingly, we reserve the right to cancel or to postpone the participation of any person according to the organizing staff’s discretion.

Termination of participation is according to the Cancellation Fees section on this Agreement.

 

7. CANCELLATION POLICY & FEES :

 

a. Canceling your participation can only be done by a phone call or e mail in advance and requires a

confirmation from Tree of Life in writing.

b. Cancellation Fees:

• From the registration day up to 30 days before the beginning of the workshop – cancellation fee of 8% of

the total participation cost.

• Cancellation between 14 – 30 days before the beginning of the workshop - you will be charged a

cancellation fee of 30% of the participation cost.

• Cancellation less than 14 days before the beginning of the workshop OR not showing to the Workshop from any reason: No refund. you will be charged 100% of the participation cost.

The minimal 8% cancellation fee is non-refundable in any circumstances. (billing, cancellation and

processing fees)

If you can't attend the workshop you may pass your Ticket to another person to take your place pending that

1) that person is approved for participation and accept these Agreement 2) A double room ticket may only be transferred to a person of the same sex.

Any refunds will be paid back to the participant up to 90 days after the end of the workshop.

 

8. TERMINATION OF PARTICIPATION

 

In the event of any termination of participation, or You leaving the workshop in the middle from any personal reasons, or in the case of You being requested to leave by the organizers from any reason,

(a) You will not be entitled to any refunds of any registration, participation service or added merchandise and services fees, and (b) any (i) outstanding balance for Workshop Participation Tuition or Ticket Cost, and (ii) other unpaid payment obligations during the remainder of the Initial Term will be immediately due and payable in full. you will be charged 100% of the participation ticket fee.

 

9. MEDICAL AND PROFESSIONAL RESPONSIBILITY AND RELEASE WAIVER

 

One who chooses to participate in the workshop has a full responsibility on his own medical condition and needs.

The workshops are directed by a qualified Doctor, (M.D. – U.S.A). The daily check-in is done in a group format where any participant may raise questions and report his/hers condition.

The workshops are designed to bring about an improvement in the quality of life, to intensify vitality of life,

and thus bring about an improvement in one’s health. Taking part in the workshop does not constitute a

regulated and standard medical care in Israel or in Your Country and does not replace any other medical

treatment you may be receiving. The venue is not a medical facility and does not offer private nursing

services. As fasting is generally beneficial for nearly all health matters it is done in a group context. There is no personal or private medical consultation available for general health issues or concerns You may have outside the scope of the fasting process. The Dr.'s attention is available for both group and private attention for issues concerning your fasting process.

The Organizers are not responsible for any medical complications what so ever of the participant, whether

they appear before, during or after the workshop. It is the participant’s duty to report of any medical

complication, side-effects or feeling of sickness before, during and after the workshop.

The Dr.'s and organizers conducting the workshop reserve the rights to break or stop the fasting process of a participant and even stop the participation in the workshop - from any reason, physical or emotional health, or any other reason arising out of professional responsibility for the participant individually or the group.

Termination of participation is according to the Cancellation Fees section on this Agreement.

Your participation in the workshop is subject to a suitable medical condition. If you know of any

medical limitation, active disease, any illness from the past, psychiatric illness, operations, hospitalizations,

sensitivity to medication, sensitivity to fruits, vegetables or foods, allergies, blood-pressure problems,

diabetes, and any kind of heart problems, you are asked to report on such prior at the time of registration.

 

10. THE JUICE FASTING AND DETOX PROCESS

 

In the nature of things, during a Fast, it is likely that there would occur a process of toxin release, known as

'Detox'. In rare cases the release of toxins can find expression in a feeling of discomfort, change in heartbeat pace or pulse, flatulence, swollenness and uncomfortable feeling in the stomach, tiredness, vomiting, fainting, lack of sleep, constant urination, emotional changes of mood, muscle cramps, dryness of skin and eyes, or specific healing process/crisis according to your state of health. The healing crisis is likely to continue, in individual cases, even after terminating the fast and as part of the healing process. In general, these symptoms - should they appear - dissipate towards the 6th day of the fast.

Just like in any medical process, one cannot know with any certainty what the particular results and effects of a fast will be on any one individually. One cannot promise with certainty to any specific person, recuperative results of any sort of disease or symptoms. During the process of the fast the body passes through a reorganization so that the symptoms of healing or side-effects are individual for each person per the state of his body, his mental state and his medical history.

At the stage of ending the fast, it is possible that there will be constipation or a slower digestive capability

than the usual, - for one week. Taking into account of what we have said above, - we provide through the

process of ending the fast additives and nutritional guidance which will reduce and even negate those

symptoms entirely. In rare cases those symptoms may continue for longer. In such circumstances, it is the

workshop participant’s responsibility to make contact with the organizers and consult them. Generally

speaking, and from our rich experience, we are able to provide you with additives and means which will

healthily reduce those symptoms.

 

EXTRA FASTING AND DETOX SERVICES & SUPPLEMENTS

 

Additional services to support the fasting and detox process such as treatments and supplements will be

provided for extra cost. Some at the Workshop to choose from and some Supplements available by online orders in advance only. These Extra services may not be used by all participants and are not priced into Your Ticket's cost. In some cases and according to your medical condition, You may be guided by the Dr. to use specific supplements or procedures to support your process. These may be available at extra cost.

 

11. WHO CAN AND WHO CAN'T PARTICIPATE IN THE WORKSHOP

 

Any person can safely fast for 7 days, except for those specific cases set out below. On the other hand,

certain people belonging to the category known in the Indian Ayurveda medicine as 'Vata' types, are likely to have relative difficulty in fasting, - more than other people. We have at our disposal unique means of

supporting the process of a successful fast over 7 days.

YOU MAY NOT PARTICIPATE IN THE JUICE FASTING WORKSHOP, or you will require specific Dr's

approval in advance, if you are having these conditions:

a. If you have Diabetes type-I or type-II or taking insulin medications.

b. Pregnant or breast-feeding.

c. Malnutrition or under-weight

d. If you are taking psychiatric medications, or have mental disorders symptoms.

e. If your medical, physical, emotional or mental condition requires nursing, personal or professional medical attention.

To the degree that there is a medical limitation, it will be examined by the doctor directing the fast and your

participation will be approved accordingly in writing.

If any of the above listed conditions (a-e) may arise before or during the Workshop your participation may be disapproved or stopped and You may be requested to leave.

 

12. DECLARATION

 

I accept and agree to the registration and participation terms as appears on this Agreement Should any damage be caused, or any discomfort whatsoever, as a result of not passing on full information as to my state of health, I will be fully responsible therefore and neither I, nor any person on my behalf shall have any claim and/or complaint in that issue.

It is known to me that during my stay at the retreat I am insured as a guest staying at the center. Any activity outside the area of the center, in person or with the group or organizers i.e, nature walks etc is on my own and total responsibility and I hereby release the workshop Organizers from any responsibility for such activities.

It is known to me that I am expected to respect a code of proper and orderly behavior, as described above

this Agreement, towards the staff and participants of the workshop and that behavior unacceptable to the

staff and organizers or that is interrupting the proper fasting process of any of the Workshop's participants

can cause the termination of my participation in the workshop and without any monetary refund.

I accept the Cancellation Policy and Termination of Participation terms of payment in the event of a

cancellation, not showing up or termination of my participation in the workshop.

 

Concerning the Fasting Process:

 

It is a free choice on my part to fast and I hereby take upon myself full responsibility for my condition. I'm fully aware of the possibility of a healing crisis, toxin release or post-fasting conditions under which my body may require more time than is usual to return to normal functioning.

It is known to me that participation in a juice-fast does not constitute an alternative to a medical treatment,

medication nor psychological treatment. The doctor directing the fast is likely to recommend a temporary

break from taking certain medicines that I am taking during the fast and for reasons of safety, (for example:

insulin consumption or medications for high blood-pressure) because of the influence of the fasting process

on the blood-pressure, on the sugar level in the blood or other medical concerns.

The workshop organizers do not recommend terminating any prior care, of any kind, unless in consultation

with the attending doctor and with his written approval. Terminating prior medical attention without the written approval of the doctor attending me, or not complying with the instructions of the doctor attending me, will be on my own responsibility alone and of my own free choice.

It is known to me that there is particular importance to the process of termination of a fast (breaking the fast) in the correct manner as it will be explained to me at the workshop. It is my duty and responsibility to take part in the instruction on how to conduct & terminate the fast that will be held for the group at the beginning & ending of the fast.
